Partner Jeffrey S. Grand Recognized As Leader In Transvaginal Mesh Lawsuits

On July 21, 2011, Partner Jeffrey S. Grand was appointed Co-Liaison Counsel in In re Pelvic Mesh Litigation, by the Honorable Carol E. Higbee of the Superior Court of New Jersey Law Division, Atlantic County, who is overseeing the centralized management for all transvaginal mesh lawsuits filed in New Jersey.  In receiving this appointment, Judge Higbee recognized Mr. Grand as a pelvic mesh lawyer with significant expertise necessary to lead the consolidated pelvic mesh litigation.  Specifically, as Co-Liaison Counsel, Mr. Grand will assist in leading the transvaginal mesh lawsuits against Johnson & Johnson subsidiary Ethicon, C.R. Bard, and other defendants.  Given that many women experienced problems with transvaginal mesh implants, including Gynecare and Avaulta pelvic mesh, which is used in the repair of pelvic organ prolapse and the treatment of stress urinary incontinence, it is expected that the number of transvaginal mesh lawsuits filed in Atlantic County will grow significantly over the coming months.  In July 2011, the U.S. Food and Drug Administration (“FDA”) issued a safety communication, advising patients and doctors to consider alternative treatments because of the high incidence of problems associated with pelvic mesh implants.  As a leading pelvic mesh lawyer, Mr. Grand is actively reviewing and filing transvaginal mesh lawsuits on behalf of plaintiffs who experienced serious and life threatening complications with pelvic mesh.

Mr. Grand Asked To Speak At Pelvic Mesh Litigation Conferences

In addition to assuming a leadership role in the consolidated pelvic mesh litigation in New Jersey, Mr. Grand was also a guest speaker at two pelvic mesh litigation conferences in September 2011 and October 2011.  As an experienced pelvic mesh lawyer, Mr. Grand shared insight regarding the course that the mass tort pelvic mesh litigation is expected to follow.  In addition to providing an overview on the current status of the pelvic mesh litigation, he discussed discovery issues pertinent to the pelvic mesh litigation.  Both pelvic mesh litigation conferences were attended by other attorneys who are representing clients injured by the transvaginal mesh implants, including Gynecare and Avaulta pelvic mesh.  As an experienced pelvic mesh lawyer, Mr. Grand provided guidance to other attorneys seeking to file transvaginal mesh lawsuits on behalf of their clients.  In addition to providing an overview on the pelvic mesh litigation, Mr. Grand discussed client screening and causation issues.  For example, in order for a pelvic mesh lawyer to successfully advocate for his client, the lawyer will need to prove that his client’s problems with transvaginal mesh were a direct result of undergoing a treatment for the repair of pelvic organ prolapse or stress urinary incontinence.

Mr. Grand Interviewed By Reuters Following FDA Mandate

On January 3, 2012, as part of its ongoing safety review of pelvic mesh implants, the FDA ordered pelvic mesh manufacturers to study rates of side effects such as organ damage, infection and painful sexual intercourse, which have been linked to pelvic mesh implants.  35 medical device manufacturers were asked to provide data on the safety and effectiveness of transvaginal mesh implant procedures.  Johnson & Johnson and C.R. Bard Inc. were among those contacted.  Johnson & Johnson manufactures several brands of mesh including Gynecare, and C.R. Bard Inc. manufactures Avaulta pelvic mesh.  Both are defendants in the consolidated pelvic mesh litigation in New Jersey.  Given his close involvement in the pelvic mesh litigation, Mr. Grand was asked to comment on the FDA mandate.  He told Reuters, “These things were put on the market without any significant testing . . . I’m hoping that all of this brings about some regulatory changes.”
