GranuFlo Attorneys File Motion to Establish Leadership Positions in Federal Dialysis Lawsuit Litigation
A group of attorneys involved in dialysis lawsuit filings over GranuFlo and NaturaLyte have motioned to establish leadership roles in the federal litigation underway in the U.S. District Court, District of Massachusetts, according to court documents.
The request, filed June 21st by six lawyers who are representing plaintiffs in federal GranuFlo and NaturaLyte-related claims, asked the U.S. District judge overseeing the proceeding to schedule its first Case Management Conference to establish structure as well as assign leadership positions for attorneys.
According to the motion, which was filed roughly two months after the federal multi-district GranuFlo litigation (MDL) was created in March, the Court should appoint an 11-member Plaintiffs Steering Committee and six-member Plaintiffs’ Executive Committee. The request also asks that two attorneys be appointed as Liaison Counsel to coordinate claims pending in the federal MDL with those that have been filed in state courts located in Massachusetts and California, to name a few.
Lawyers are asking that leadership roles be chosen prior to the Case Management Conference so parties can meet beforehand to negotiate issues relevant to the litigation’s structure.

These NaturaLyte and GranuFlo lawsuits allege cardiovascular death, heart attacks and other injuries stemming from the acid concentrates manufactured by Fresenius Medical Care. The medications were taken off the market by the U.S. Food and Drug Administration (FDA) in June 2012 by way of a Class I recall, which is the most serious type of recall and is only administered when there is reasonable cause that a drug or medical device may lead to serious side effects and/or death.
The fact that GranuFlo lawsuit filings over the drug, which contains a high amount of an ingredient the body converts to bicarbonate during a dialysis treatment, are being filed at a rapid rate, establishing an organizational structure for the proceeding may be especially beneficial. According to the motion filed in June, more than 300 dialysis lawsuits alleging life-threatening cardiovascular injuries and death had been filed in the litigation since it was formed.
