Denture Cream Litigation MDL Created

On June 9, 2009, the Judicial Panel on Multidistrict Litigation (JPML) issued an order centralizing In re: Denture Cream Product Liability Litigation, MDL-2051, in the Southern District of Florida before Judge Cecilia M. Altonaga, who the JPML said "has the time and experience to steer this litigation on a prudent course."
The JPML concluded that transfer under "Section 1407 will eliminate duplicative discovery; prevent inconsistent pretrial rulings; conserve the resources of the parties, their counsel and the judiciary." The court highlighted that "[t]hese actions share questions of fact arising out of the allegation that the levels of zinc contained in certain brands of denture cream can cause copper deficiency and neurological injuries."
Bernstein Liebhard's denture cream lawyers are pursuing denture cream lawsuits against the manufacturers of Poligrip and Fixodent.
Denture Cream MDL Organization
The first MDL status conference is scheduled for July 8, 2009 in Miami, Florida. On July 13, 2009, Partner Eric Chaffin of Bernstein Liebhard LLP was appointed to the Plaintiffs Steering Committee and as State/Federal Court Liaison Counsel by Judge Altonaga of the Southern District of Florida in the federal denture cream MDL, In re Denture Cream Products Liability Litigation, Case No. 09-2051, by order dated July 13, 2009. Mr. Chaffin is also proposed Co-Liaison Counsel for Plaintiffs in the Philadelphia denture Cream Mass Tort Program, In re: Denture Adhesive Cream Litigation, Philadelphia Court of Common Pleas, March Term, 2009, No, 4534, by Judge Moss.

Denture Cream Referrals
