10 DePuy Pinnacle Hip Lawsuits Enter Pool for Bellwether Trial Program
The U.S. District Court, Northern District of Texas has chosen ten possible DePuy Pinnacle hip lawsuits to serve in the federal multidistrict litigation (MDL)’s bellwether trial program, according to court documents.
A federal judge presiding over claims involving the metal hip replacement published a list of cases on February 18th that will be prepared for trial. The DePuy Pinnacle lawsuits, which have been filed against Johnson & Johnson and its subsidiary, DePuy Orthopaedics, similarly involve a version of the hip replacement that includes a metal Ultamet liner and has been associated with pain, swelling, metal ion poisoning (metallosis) and related symptoms of premature device failure. According to a Court order in February, all cases in the MDL will remain stayed in the proceeding until all bellwether trials are concluded, or for shown good cause.
7,200 Pinnacle Hip Lawsuits Now Pending in Texas Litigation
A Case List updated February 2nd on the Court’s website shows more than 7,200 Pinnacle claims now pending in the Northern District Court, Northern District of Texas, after being filed by plaintiffs who similarly accuse Johnson & Johnson and DePuy of failing to adequately warn about risks associated with the metal-on-metal version of its Pinnacle implant. According to claims, these hip complications stem from its propensity to shed metal debris into the recipient’s blood stream and surrounding tissue.
Similar issues have been alleged by individuals who have filed lawsuits over another one of DePuy’s metal hip implants. The ASR hip replacement system, which was designed for similar purposes, was recalled due to excessively high failure rates in August 2010, and has been named in thousands of lawsuits. Plaintiffs involved in Pinnacle-related lawsuits question whether this device should have been pulled off the market as well. In May 2013, Johnson & Johnson and DePuy announced its decision to stop selling this and a number of other metal-on-metal hip replacements due to slowing demand of such products.
The first federal trial in the Pinnacle litigation concluded in October 2014 with a verdict in favor of the defense, court documents indicate.
