DePuy Pinnacle lawsuit claims have been added to certain cases involving the company’s ASR metal-on-metal artificial hip in a consolidated proceeding underway in California Superior Court, according to court records.

As of July 2013, the judge overseeing the DePuy ASR hip litigation  has permitted seven plaintiffs to include claims involving a version of the Pinnacle hip that uses a metal Ultamet liner to their lawsuits. According to recent documents, thousands of cases filed over this device are currently pending in a federal litigation underway in the U.S. District Court, Northern District of Texas. Meanwhile, hundreds of DePuy ASR lawsuit claims have been filed in a separate proceeding created in the Northern District of Ohio. (In re: DePuy Orthopaedics, Inc. Despite No DePuy Pinnacle Recall, Cases Move Forward

State and federal litigations involving the DePuy Orthopaedics-manufactured Pinnacle and ASR hip devices are all moving forward at a steady rate, however. In the California state proceeding of DePuy ASR lawsuits, plaintiffs recently saw a victory when more than $8 million in damages was awarded to a patient who sustained injuries stemming from the metal-on-metal implant.

The first bellwether trial in the federal DePuy ASR litigation is scheduled to begin on September 9, 2013.

According to court documents, plaintiffs who have filed claims over the Pinnacle hip and ASR metal-on-metal device allege both the implants have the potential to cause adverse tissue reactions and painful side effects associated with metallosis (metal ion poisoning), which occurs when metallic debris sheds into the blood stream. Despite no announcement of a DePuy Pinnacle recall, plaintiffs involved in lawsuits over the device allege it shares similar design defects to the ASR, which was recalled in August 2010.

Plaintiffs involved in DePuy Pinnacle lawsuits allegedly experienced side effects related to the:

  • Heart (chest pain, shortness of breath)
  • Nerves (numbness, weakness, change in vision or hearing)
  • Kidney (change in urination habits)
  • Thyroid (fatigue, feeling cold, weight gain)
