Bernstein Liebhard LLP Clients Share Stories Of Their Hip Replacement Failure

Bernstein Liebhard LLP’s DePuy hip replacement clients were recently featured in a July 12, 2012 Reuters  article on escalating DePuy hip lawsuits. The article shared the stories of hip replacement failure experienced by two of the firm’s clients, one who had an ASR hip implant and one who had a Pinnacle metal-on-metal hip implant.

Frances Grisham, from Jackson, Tennessee, recently had revision surgery to repair the fracture to her left hip caused by the DePuy ASR hip implant. Before her revision surgery, like many other victims of the ASR hip recall, she had elevated levels of cobalt and chromium.

Harriett Bowen, from Salisbury, Maryland, received a DePuy Pinnacle metal-on-metal hip replacement in 2008 and developed the same symptoms as Ms. Grisham, including pain, limited mobility, and elevated levels of cobalt and chromium in her blood. In July 2011, Bowen’s left hip fractured at the implant site and required additional surgery.  Doctors determined that her cobalt and chromium level was worrying.

Bowen has not received compensation for her surgery and has filed a DePuy hip lawsuit against J&J. “I have never done anything like this before, but considering what I went through for three years, I feel like I should be compensated,” Bowen said.

Bernstein Liebhard LLP told Reuters that although the DePuy ASR recall in 2010 led doctors to notify patients and monitor high metal levels, problems with the DePuy Pinnacle metal-on-metal hips are not being reported as systematically since the devices weren’t recalled. “At the end of the day we will see a similar occurrence of high metal levels in Pinnacle metal-on-metal recipients as more and more of them get their blood tested. That is certainly what we are seeing in our client population.”

J&J currently faces over 6,000 lawsuits related to the DePuy ASR and Pinnacle metal-on-metal hip replacements, and the lawyers at our firm are actively filing cases on behalf of our clients. Metal-On-Metal Hip Lawsuits Mounting As More Information On The Dangers Of Hip Implants Emerge

There have been nearly 17,000 adverse events reports regarding metal-on-metal hips reported to the U. S. Food and Drug Administration (“FDA”) from 2000-2011 from patients who experienced hip replacement failure and complications such as metallosis and requiring revision surgery.

A survey taken by the American Academy of Orthopaedic Surgeons in 2012 showed that 16 percent of surgeons used metal-on-metal hip implants before the FDA warning of potential hip metal hip replacement problems. After the warning, the number dropped to 10 percent, and doctors say that the number continues to dwindle.

Recently, the FDA convened and expert advisory panel to discuss the safety of metal hip replacement. During the two day hearing, experts, doctors, medical device manufacturers and patients offered testimonies about the risks of metal-on-metal hip implants. Although the FDA did not issue specific restrictions on metal hip implant use, they cautioned medical professionals against using metal-on-metal hip implants whenever possible.

In addition to the DePuy ASR and Pinnacle metal-on-metal hip implants, Bernstein Liebhard LLP is also pursuing lawsuits against other manufacturers on behalf of individuals experiencing metal hip replacement failure.
