Plaintiffs around the country continue to file Xarelto lawsuits over the serious side effects allegedly associated with the blood-thinning medication. According to an update issued by the U.S. Judicial Panel on Multidistrict Litigation on November 15th, there are now 13,727 cases pending in a centralized proceeding currently underway in the U.S. District Court, Eastern District of Louisiana.

Xarelto Filings Continue

The federal Xarelto docket was consolidated in the Eastern District of Louisiana in December 2014. Initially, the multidistrict litigation included just 21 cases. Two years later, Xarelto lawsuit plaintiffs continue to file claims directly in the proceeding, while additional complaints are reported to be pending in state and federal courts around the U.S.

One of the most recent lawsuits was filed in Illinois on November 14th. The complaint, which is now pending in Cook County Circuit Court, was brought on behalf of a woman who claims to have suffered severe physical injuries as the result of ingesting Xarelto. She alleges that the drug’s manufacturers, including Bayer AG and Janssen Pharmaceuticals, Inc., failed to inform patients of Xarelto’s potentially harmful side effects. (Case No. 2016L01117)

Xarelto is a new generation blood thinner that was only launched in 2011. While the drug’s manufacturers tout it as an improvement over warfarin, plaintiffs in Xarelto lawsuits point out that there is currently no approved antidote to reverse internal bleeding that sometimes occurs among patients who use the blood thinner. While warfarin can cause similar bleeding, the complication can be reversed via the administration of vitamin K. Plaintiffs also assert that a regular blood testing regimen to assure appropriate dosage would benefit many Xarelto patients, despite the manufacturers’ promises that such monitoring is not necessary.

The federal Xarelto litigation is scheduled to begin a series of bellwether trials in March 2017. Verdicts in these trials could provide valuable insight into how other juries might decide similar Xarelto lawsuits.
