On March 25, 2011, a motion to consolidate all pending federal DePuy Pinnacle lawsuits was filed by a plaintiff in one of the DePuy Pinnacle lawsuits. In her petition to the U.S. Judicial Panel on Multidistrict Litigation, plaintiff Catherine Falvey requested that the panel consolidate all of the federal DePuy Pinnacle lawsuits into their own multidistrict litigation (“MDL”) or make them part of the DePuy ASR hip implant MDL, which is currently underway in the U.S. District Court for the Northern District of Ohio. Falvey’s case is currently pending in the U.S. District Court for the Central District of California.

Benefits of Coordinating Federal DePuy Pinnacle Lawsuits into an MDL

If the panel grants Falvey’s motion, all of the federal DePuy Pinnacle lawsuits will be consolidated and centralized in one court before one judge for coordinated pre-trial proceedings. Falvey contends that because all of the DePuy Pinnacle lawsuits involve common issues of fact, consolidation is appropriate. The MDL panel is expected to hear oral arguments on the matter at the next scheduled hearing, which will be held on May 16, 2011. If the panel grants the motion, the DePuy Pinnacle lawsuits will either become part of the pending DePuy ASR hip implant MDL or a new MDL focused solely on the DePuy Pinnacle lawsuits will be formed.

Although the Pinnacle hip system was not part of the massive DePuy ASR hip recall issued in August 2010, recipients have also experienced hip replacement failure due to similar design defects found in both the Pinnacle and ASR hip replacement devices. As with the DePuy ASR hip replacements, the Pinnacle hip system is a metal-on-metal device. There is a growing consensus that the Pinnacle hip system should be recalled as well. In fact, there have been over 1,300 adverse event reports filed with the U.S. Food and Drug Administration (“FDA”) over the Pinnacle hip systems since the nationwide DePuy ASR hip recall. In addition, a growing number of DePuy Pinnacle lawsuits have been filed.
