On August 17, 2009, Bernstein Liebhard LLP Partner Eric Chaffin and one of his clients, Amber Presson, will appear as guests on Fox & Friends (Fox News) about denture cream zinc poisoning lawsuits. Mrs. Presson is a 31 year old mother and Michigan resident who received dentures when she was 20 years old because of a traumatic injury. Until January 2009, Ms. Presson used SuperPoligrip to secure her dentures and now, Bernstein Liebhard, has filed a denture cream lawsuit against GlaxoSmithKline (GSK) and related entities in Philadelphia, Pennsylvania on behalf of Mrs. Presson alleging that SuperPoligrip caused her to suffer from zinc poisoning, copper deficiency, hematological disorders and neurological disorders that impact her ability to walk. In addition to Mrs. Presson’s case, Bernstein Liebhard has filed 14 other lawsuits on behalf of consumers allegedly poisoned from zinc in denture creams, including SuperPoligrip and Fixodent formulas and is actively reviewing and accepting cases from consumers nationwide against the manufacturers of Fixodent and SuperPoligrip.
About the Fox News coverage, Mr. Chaffin stated, “the goals of the lawsuits on behalf of Mrs. Presson and others is to get compensation for the victims and their families and to convince GSK and P&G that they need to place adequate warnings on their denture creams so that consumers are not poisoned from the zinc. There are also various alternative designs that would prevent consumers from poisoning themselves. For example, instead of the current packaging used, denture creams with zinc could come in tubes with measurement devices that allow consumers to measure the amount of cream being used so they do not use too much and poison themselves. This is particularly important because many denture wearers have poor fitting dentures and the companies know that denture wearers are using a lot of denture cream.� Mr. Chaffin further stated, “we believe that we will be able to show at trial that GSK knew of the zinc poisoning problem and deliberately took no affirmative steps to prevent these serious injuries. A company cannot be permitted to simply put its head in the sand when there is such a serious problem with its product. The injuries to these consumers from the denture cream are completely life altering and these people will never be the same again.�
In addition to appearing on Fox & Friends, Mr. Chaffin has also appeared on other television and radio stations about denture cream zinc poisoning, including ABC and Court Radio. In May 2009, for example, Mr. Chaffin appeared on ABC’s Good Morning America about denture cream lawsuits, along with another one of his clients, Ellen Isaacs, who also allegedly suffers from zinc poisoning and copper deficiency from SuperPoligrip. Mrs. Isaacs’ allegedly suffers from such debilitating neurological injuries from SuperPoligrip that she must use a walker for walking. Mrs. Isaacs’ lawsuit, like Mrs. Presson’s, is pending in state court in Philadelphia against GlaxoSmithKline. The GMA also featured an interview of Dr. Sharon Nations, who is a researcher and author out of Texas who has published an article in Neurology about zinc poisoning from denture cream.
Mr. Chaffin currently serves as a court-appointed member of the Plaintiffs’ Steering Committee and State/Federal Court Liaison Counsel in the federal multi-district denture cream litigation (MDL) pending in the Southern District of Florida. He is also the court-appointed Co-Liaision Counsel in the Philadelphia, Pennsylvania state court denture cream Mass Tort Program (MTP).
