On March 4, 2011, a Darvon/Darvocet class action was filed against Mylan Pharmaceuticals Inc., Teva Biopharmaceuticals USA, Inc. and Qualitest Pharmaceuticals, Inc. for failure to warn consumers about the dangers associated with the recalled painkillers. This particular Darvon/Darvocet class action complaint was filed by plaintiffs Paul Neil Smith, Norma Sue Gibson Lanning and Jimmy Blanton in the United States District Court of Maryland, Baltimore Division. All of the plaintiffs in this Darvon/Darvocet class action claim that they sustained serious cardiac problems as a result of taking the generic forms of the painkillers.

Darvon/Darvocet Lawsuits Filed Nationwide

In November 2010, prompted by a recommendation from the U.S. Food and Drug Administration (“FDA”) and a growing number of adverse event reports, Darvon, Darvocet, and the generic forms of propoxyphene were recalled. The recall was issued after the FDA determined that these painkillers increased the risk of heart failure and death. Since the November recall, numerous lawsuits have been filed throughout the country. In order to deal with the mounting Darvon/Darvocet lawsuits, a motion is currently pending before the U.S. Judicial Panel on Multidistrict Litigation to have the lawsuits consolidated into an MDL. If the MDL motion is granted, the individual lawsuits will be consolidated for pretrial proceedings before one judge. A hearing to determine whether the Darvon/Darvocet litigation will be centralized was held on March 30, 2011 in California.

While it is possible that an MDL will be granted to deal with the individual lawsuits filed throughout the country, there are also pending Darvon/Darvocet class action lawsuits.
