On April 11, 2011, the U.S. Judicial Panel on Multidistrict Litigation issued a show cause order for plaintiffs in 10 states petitioning for the formation of a Multidistrict Litigation (“MDL”) to consolidate the Darvon/Darvocet lawsuits currently pending in federal courts nationwide. The panel gave plaintiffs in 18 separate Darvon/Darvocet lawsuits one month to file arguments in support of consolidating the Darvon/Darvocet lawsuits into an MDL. The seven-judge panel is headed by the Honorable John G. Heyburn II of the Western District of Kentucky. Xanodyne Pharmaceuticals, manufacturer of the brand versions of Darvon and Darvocet, has opposed consolidating the litigation, claiming that much of the discovery and evidence in the Darvon/Darvocet lawsuits are based on each individual plaintiff’s specific injuries. Further, the manufacturer claims that many of the cases stem from patients’ use of the generic forms of Darvon and Darvocet.

Allegations in the Darvon/Darvocet Lawsuits

Plaintiffs involved in the Darvon/Darvocet lawsuits allege that the pain medications caused them to sustain heart problems such as heart arrhythmia or sudden heart-related deaths. Further, plaintiffs claim that the drug manufacturer, Xanodyne Pharmaceuticals, failed to adequately research the dangerous side effects associated with Darvon and Darvocet as well as failed to warn doctors and patients that propoxyphene pain medications cause fatal heart rhythm problems.

FDA Issues Darvon/Darvocet Recall

In November 2010, prompted by a recommendation from the U.S. Food and Drug Administration (“FDA”) and a growing number of adverse event reports, Darvon, Darvocet, and the generic forms of propoxyphene were recalled. The recall was issued after the FDA determined that these painkillers increased the risk of heart failure and death.
