Bernstein Liebhard LLP, a staunch advocator for those injured by defective medical devices, supports the latest action taken by the U.S. Food and Drug Administration (“FDA”), warning consumers of the dangers associated with transvaginal mesh (“TMV”).  It is our opinion that the FDA’s ongoing review of TVM is beneficial as it will help consumers make informed decisions and ultimately benefit the safety and welfare of those affected by Pelvic Organ Prolapse (“POP”). Specifically, on July 13, 2011, the FDA issued a safety communication advising patients and doctors to consider alternative treatments to TVM.  Additionally, the FDA announced that it will convene to discuss whether TVM should be removed from the market.  Further, the FDA recommended that women suffering from POP refrain from undergoing surgical placement of TVM because the implants expose them to an increased risk of sustaining serious and fatal injuries.

TVM is a device that is surgically implanted into the vaginal wall to treat complications occurring after childbirth and pregnancy.  According to the FDA announcement, in 2010, an estimated 75,000 women received TVM implants in order to repair POP, a common condition in which a woman’s uterus, bladder or rectum, change position.  The FDA announcement also noted that  studies have shown that women who receive TVM implants are more likely to suffer mesh erosion, as well as other complications that require additional surgeries to remove the mesh.
