Many individuals who underwent hip replacement surgery and received a metal-on-metal hip replacement are worried about their hips failing. In August 2010, DePuy issued a worldwide hip implant recall of its ASR hip replacement systems. Although the ASR implants were the only metal-on-metal hips that were subject to the recall, several other brands and models of metal hips are still available on the market. It appears that those who received the DePuy Pinnacle metal-on-metal hip system may also face an increased risk of hip replacement failure. Many are wondering, “Have Pinnacle hip replacements been recalled?” Although there are similarities between the ASR hip replacements and certain Pinnacle implants, the Pinnacle hip replacements have not been recalled. Nevertheless, the number of DePuy Pinnacle hip replacement lawsuits filed by individuals who suffered from hip replacement failure continues to grow. On May 23, 2011, the United States Judicial Panel on Multidistrict Litigation consolidated and centralized the Pinnacle hip lawsuits filed in federal courts nationwide, which are now pending in the U.S. District Court for the Northern District of Texas. The Honorable James E. Kinkeade is overseeing the consolidated litigation. Currently, the number of Pinnacle hip replacement lawsuits top 900.

Large Number of Pinnacle Hip Replacement Lawsuits In Discovery Phase

Discovery is moving forward in the DePuy Pinnacle hip replacement lawsuits. Judge Kinkeade assigned plaintiffs’ counsel to leadership roles and appointed a Special Master. Bernstein Liebhard LLP partner Jeffrey S. Grand was appointed to both the Plaintiffs’ Steering Committee and the Discovery Committee. James M. Stanton will serve as Special Master, and will assist the court with managing pre-trial, trial, and post-trial tasks. In this role, he will assist in expediting the litigation and ensure that court orders are followed.

Have Pinnacle Hip Replacements Been Recalled?

The surge in the number of Pinnacle hip replacement lawsuits came on the heels of the ASR hip implant recall. In August 2010, Johnson & Johnson (“J&J”), the parent company of DePuy Orthopaedics, issued a voluntary worldwide recall of the ASR hip implants due to their high failure rates. A study from the National Joint Registry of England and Wales showed that 1 out of 8 patients who received the device had to undergo revision surgery within five years finally prompted the company’s decision. Many of those with Pinnacle hip implants are wondering, have Pinnacle hip replacements been recalled too? Although J&J maintains that the Pinnacle hip systems are not defective, patients who received the metal-on-metal Pinnacle hip systems have reported similar adverse effects associated with the metal-on-metal DePuy ASR hips. In fact, plaintiffs involved in the Pinnacle hip MDL allege that DePuy failed to adequately research the metal-on-metal Pinnacle hip implant, and failed to warn consumers of its risks. Plaintiffs also allege DePuy failed to issue a recall even with knowledge of the metal-on-metal hips’ dangers. Despite the absence of a recall, the number of Pinnacle hip replacement lawsuits filed continues to grow.
