According to court documents released on October 6, 2011, there are now at least 538 DePuy Pinnacle hip replacement lawsuits pending before U.S. District Court Judge James E. Kinkeade, who is presiding over the consolidated DePuy Pinnacle hip replacement lawsuits.  The federal DePuy Pinnacle hip replacement lawsuits have been consolidated into a multidistrict litigation (“MDL”) before Judge Kinkeade in the U.S. District Court for the Northern District of Texas.  Interestingly, in May 2011, when the U.S. Judicial Panel on Multidistrict Litigation ordered that all DePuy hip Pinnacle hip replacement lawsuits filed in federal courts throughout the country be consolidated, only three DePuy Pinnacle hip replacement lawsuits had been filed.  Five months later, the number of DePuy Pinnacle hip replacement lawsuits pending before Judge Kinkeade has grown to over 500.  More than 300 of these DePuy Pinnacle hip replacement lawsuits were filed within the last two months.  Currently, the rate at which plaintiffs are filing DePuy Pinnacle hip replacement lawsuits is greater than 100 per month.  As hip injury lawyers continue to investigate and review claims by individuals who were injured as a result of receiving a Pinnacle hip implant, the number of DePuy Pinnacle hip replacement lawsuits filed is expected to continue to rise.  Plaintiffs filing DePuy Pinnacle hip replacement lawsuits allege that DePuy, a subsidiary of pharmaceutical and medical device manufacturer, Johnson & Johnson, defectively designed the DePuy Pinnacle hip implants, that the company failed to warn consumers about the risks associated with the DePuy Pinnacle hip implants, and that the company knew of these risks yet failed to issue a DePuy Pinnacle hip recall.  In fact, the DePuy Pinnacle hip implants remain on the market.

Rise In DePuy Pinnacle Hip Replacement Lawsuits Coincides With FDA Complaints

In addition to the growing number of DePuy Pinnacle hip replacement lawsuits, the U.S. Food and Drug Administration (“FDA”) has received a surge in adverse event reports involving the DePuy Pinnacle hip implants.  Between July and September of this year, the FDA received 709 adverse event reports stemming from the DePuy Pinnacle hip implants.  Of these, 201 adverse event reports involved DePuy Pinnacle hip implants with metal liners.  Although the DePuy Pinnacle metal-on-metal hip implants have not been recalled, the FDA is clearly concerned about the serious risks and complications associated with the devices.  In fact, earlier this year, the FDA launched a website dedicated to providing consumers with information about the risks associated with metal-on-metal hip implants.  Signs of metal-on-metal hip replacement failure include pain, popping, grinding, as well as more severe complications, including metal poisoning, which occurs when metal debris sheds from the DePuy Pinnacle hip implants damaging the surrounding tissue and entering the bloodstream.

DePuy ASR Hip Replacements Modeled After Pinnacle Hip Implants

Johnson & Johnson is also defending thousands of lawsuits filed by individuals who received DePuy ASR hip replacements.  Although the DePuy ASR hip replacements were recalled in August 2010, and the Pinnacle hip implants remain on the market, both products have similar design defects.  These similarities are not surprising considering that the DePuy ASR hip replacement system received FDA market clearance because the manufacturer claimed it was substantially similar to the DePuy Pinnacle hip implants, which were already available to consumers.  Thus, the allegations involved in both the DePuy ASR hip lawsuits and the DePuy Pinnacle hip replacement lawsuits are of a similar nature.
