Federal Judge Schedules DePuy Pinnacle MDL Conference For April 25, 2012
Bernstein Liebhard LLP reports that on April 5, 2012, the Honorable James E. Kinkeade, who is overseeing In re: DePuy Orthopaedics, Inc. Pinnacle Hip Implant Products Liability Litigation (“MDL No. 2244”), currently underway in the U.S. District Court for the Northern District of Texas, issued an order scheduling a conference with a committee of lawyers appointed by the court to help coordinate the litigation. The status conference is set for April 25, 2012 at 9:30 a.m. at 1100 Commerce Street, Room 1625, Dallas, Texas. Previously, on April 2, 2012, a Master Case List was entered by the court, detailing the case numbers, filing dates, and transferor districts of the Pinnacle hip replacement lawsuits pending before Judge Kinkeade. According to the Master Case List, as of March 31, 2012, there were more than 1,100 DePuy hip replacement lawsuits before Judge Kinkeade in the DePuy Pinnacle MDL.
Directions For Counsel Set Out In DePuy Pinnacle MDL Order
In preparation for the conference, the April 5, 2012 order directed the parties to confer with the Special Master within 7 days of its filing in order to begin working on the following matters: (1) input for a Case Management Order to establish a firm schedule for the parties to follow during the pendency of the litigation; (2) analysis of creating separate tracks for different configurations of the Pinnacle-brand device within the DePuy Pinnacle MDL; (3) guidelines for plaintiffs’ attorneys regarding credit for work completed for the common-benefit of all plaintiffs in the DePuy Pinnacle MDL; (4) agreements for a long-form and short-form complaint procedure; (5) a standardized fact sheet to be completed by plaintiffs; (6) protocol for joint production of ASR and Pinnacle documents, designation of privileged documents, and a procedure for challenging privilege designations; and (7) coordination with state MDL proceedings.
