Bernstein Liebhard LLP reports that following a January 9, 2012 Case Management Order, which appointed plaintiffs’ counsel to serve on various leadership committees in In re: DePuy Orthopaedics, Inc. Pinnacle Hip Implant Products Liability Litigation (“MDL No. 2244”), currently underway in the U.S. District Court for the Northern District of Texas, Judge James E. Kinkeade issued additional orders so that the litigation can proceed to the next phase.  Judge Kinkeade appointed James M. Stanton to be the Special Master of these DePuy hip replacement lawsuits.  The Special Master will help the court with pre-trial, trial and post-trial tasks.  The Special Master’s duties include:  assisting with the preparation of attorney conferences; supervising discovery; managing the docket; assisting with evidentiary issues; providing legal analysis; responding to media inquiries; coordinating federal, state and international litigations; ensuring compliance with court orders; and assisting with settlement negotiations.

Discovery Stay Lifted; Litigation Progresses To Next Stage

Following the judicial appointments, Judge Kinkeade lifted a stay of discovery.  Discovery has been stayed in this litigation since June 29, 2011. Now that leadership roles have been assigned and a Special Master appointed, discovery and motion practice can move forward.  The initial discovery process will likely involve the identification and noticing certain witnesses for depositions.  In addition to naming DePuy hip replacement lawyers to leadership roles, and appointing Special Master James M. Stanton, the U.S. Judicial Panel on Multidistrict Litigation transferred three additional hip replacement lawsuits to the Pinnacle hip MDL.
