On March, 25, 2011, plaintiff Catherine Falvey filed a petition with the U.S. Judicial Panel on Multidistrict Litigation to consolidate all of the federal Pinnacle hip lawsuits that Johnson & Johnson and their DePuy Orthopeadics subsidiary is currently defending nationwide. The motion requested that the panel either designate a new court to oversee the Pinnacle lawsuits and form a separate multidistrict litigation (“MDL”) or make the Pinnacle lawsuits part of the DePuy ASR hip implant MDL, which is currently underway in the U.S. District Court for the Northern District of Ohio. The lawyers at Bernstein Liebhard LLP are currently investigating and litigating cases on behalf of Bernstein Liebhard’s clients who have undergone both DePuy Pinnacle and DePuy ASR hip implant surgery and are offering free and confidential legal consultations to individuals who received the defective hip implants.

In August 2010, DePuy issued a nationwide recall of all ASR hip replacement implants. Although the Pinnacle was not included in the recall, it has much in common with the recalled ASR hip implants, as both are metal-on-metal hip replacement devices. Thus, Pinnacle hip implant recipients often experience hip replacement failure symptoms akin to that of patients who received the ASR hip devices.

DePuy MDL for Pinnacle Hip Systems

If the U.S. Judicial Panel on Multidistrict Litigation grants Falvey’s request, all of the federal DePuy Pinnacle lawsuits will be consolidated and centralized before a single judge for pretrial purposes. If the panel agrees to form a DePuy Pinnacle MDL, the cases will either be included with the ASR hip lawsuits that are part of the DePuy ASR hip implant MDL in the U.S. District Court for the Northern District of Ohio or a new MDL will be formed that will solely focus on DePuy Pinnacle lawsuits.

Since DePuy was forced to recall the defective ASR hip implants in August, Bernstein Liebhard LLP has provided a wealth of consumer information concerning both the Pinnacle and ASR hip systems on its website, If you or a loved one have had hip replacement surgery and have been implanted with a defective DePuy hip, you may be entitled to compensation for medical bills, pain and suffering, lost wages and other injuries.
