Grand was named to both the Plaintiffs’ Steering Committee (“PSC”) and the Discovery Committee in In re: DePuy Orthopaedics, Inc. Pinnacle Hip Implant Products Liability Litigation (“MDL No. 2244”) by Judge James E. Kinkeade, which is currently underway in the U.S. District Court for the Northern District of Texas.*  More than a hundred lawsuits have been filed against Johnson & Johnson, the pharmaceutical giant that is also the parent company of DePuy Orthopaedics, Inc.  These DePuy hip replacement lawsuits were centralized in the Northern District of Texas on May 23, 2011, by order of the United States Judicial Panel on Multidistrict Litigation.**

In response to receiving this appointment, Mr. Grand commented, “We look forward to working with the other attorneys on the PSC and moving this litigation forward on behalf of all those injured by defective Pinnacle hip systems.”

Mr. Grand’s appointment follows his extensive experience in other high-profile cases involving defective medical devices and dangerous drugs including pelvic mesh, Vioxx, Fosamax and Yaz.  He has supervised the day-to-day management of complex, multi-party mass tort litigation in state and federal courts and multi-district litigation throughout the United States, and has served on discovery and administrative committees in these litigations.  He has served as a member of the trial teams that obtained a $47.5 million verdict for Vioxx-related cardiovascular injury in Humeston v. Merck & Co., in New Jersey Superior Court in 2007, and several plaintiff victories in the Chinese-Manufactured Drywall Products Liability Litigation in the United States District Court, Eastern District of Louisiana.

Metal-on-Metal Hip Replacement Implants Spur Litigation

In August 2010, Johnson & Johnson issued a worldwide recall of its ASR metal-on-metal hip implants due to their excessively high failure rates.***  The recall was prompted by a study from the National Joint Registry of England and Wales, which concluded that 1 out of every 8 patients who received the devices had to undergo revision surgery within five years.  Although the metal-on-metal Pinnacle hip replacement devices in the Pinnacle hip lawsuits were not subject to the hip replacement recall 2010, plaintiffs allege that they share similar design defects to the ASR hip devices.  According to a recent article in the New York Times, more than 5,000 metal-on-metal hip replacement lawsuits have been filed; 3,500 of these hip replacement lawsuits involve hip implants that were subject to the ASR hip recall.****
