On April 10, 2012, the Honorable David A. Katz issued an order to schedule a status conference in the DePuy ASR MDL, currently underway in the U.S. District Court for the Northern District of Ohio. The status conference will involve a committee of lawyers appointed by the court to help coordinate the litigation, and is set for May 1, 2012. An open court conference is set to commence at 12:30 p.m. later that day.

In August 2010, DePuy issued a worldwide hip replacement recall of its ASR hip implants after data revealed that the devices had excessively high failure rates. Amidst mounting litigation following the ASR hip recall, lawsuits filed in federal courts nationwide were consolidated into a multidistrict litigation and assigned to Judge Katz. Approximately, 3,300 lawsuits have been filed in the DePuy ASR Hip MDL, with new cases being filed each day. In addition to the federal DePuy ASR lawsuits, individuals have filed similar lawsuits in state courts throughout the country.

Bellwether Trials For Metal Hip Replacement Lawsuits In DePuy ASR MDL To Be Discussed

On March 5, 2012, Judge Katz vacated a DePuy ASR MDL status conference on that was originally scheduled for March 15, 2012. According to the order, Judge Katz vacated the conference because “discovery is proceeding apace which negates the necessity.” Judge Katz held a telephonic status conference on March 15, 2012 in lieu of the meeting. During the telephonic status conference, he requested the lead counsel to meet and confer to discuss the issue of bellwether trials for the initial group of hip replacement lawsuits. The “bellwether” trials are intended to try cases that are generally representative of plaintiffs’ claims, and to determine the strength of plantiffs’ claims as well as the extent of defendants’ potential liability. Judge Katz ordered lead counsel to submit a joint proposal of competing bellwether trial selection protocols by April 27, 2012. Meanwhile, key witnesses in the DePuy ASR MDL continue to be deposed.
