Stern recently gave to Art Buono, the co-author of on the DePuy ASR hip recall litigation.  Since the DePuy ASR artificial hip recall  was initiated in August 2010, lawyers at the Firm have been actively investigating and reviewing hundreds of claims by individuals who received the defective hip devices.  As a result of these efforts, the “firm has a substantial number of cases pending in the sprawling complex of lawsuits this defective medical device has spawned.”  In the interview, entitled “DePuy ASR Hip Implant Failures Mount, with Devastating Effects,” Ms. Stern explains that patients experiencing hip replacement failure as a result of the DePuy ASR hip implants face painful revision surgeries in order to have the defective hip implants removed, and metal poisoning, which occurs when metal ions detach from the implant and enter the bloodstream.

The interview also touches on the highly-criticized FDA approval process, which allowed these defective devices to receive market clearance.  Specifically, the interview discusses how in August 2005, DePuy Orthopaedics, a subsidiary of Johnson & Johnson, used a “loophole” in the FDA regulatory process to obtain approval for its ASR hip implants without conducting clinical trials.  In order to utilize this fast-track approval process, medical device manufacturers are only required to show that their product is substantially similar to others available on the market.  As the number of DePuy ASR hips fail, the number of DePuy ASR hip lawsuits filed against DePuy continues to grow.  Given that 37,000 Americans received the recalled hip devices, the direct correlation between the excessively high failure rate and the spike in litigation is not surprising.  Ultimately, as Mr. Buono points out is “[t]he sad irony behind the physical tragedies these patients endure is that J&J aggressively marketed the ASR as a superior design that would last far longer than existing hip replacement systems.”
