The Honorable David A. Katz issued a series of orders following Tuesday’s hearing in the DePuy ASR hip implant MDL.  The three orders involved protocol regarding the preservation of explants for DePuy ASR plaintiffs undergoing revision surgery; a case management order detailing the guidelines that plaintiffs and defendants must adhere to when filing complaints and answers (attached to this order is a template of the short form complaint that plaintiffs’ attorneys must use when initiating an ASR lawsuit against DePuy, as well as a standard answer form that DePuy’s attorneys must use when responding to plaintiffs’ allegations); and a protective order of confidentiality regarding documents produced during the discovery process.

The string of orders issued by Judge Katz are common in multidistrict litigation, because they serve to establish uniform procedures for litigants to follow by helping to maintain structure and consistency as the litigation advances.  Check back for details on the specifics of each order.
