Federal Judge Schedules DePuy ASR MDL Status Conference For January 23, 2012
Bernstein Liebhard LLP reports that on January 9, 2012, the Honorable David A. Katz, who is overseeing In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation (“MDL No. 2197”), currently underway in the U.S. District Court for the Northern District of Ohio, issued an order scheduling a status conference with a committee of lawyers appointed by the court to help coordinate the litigation.* The status conference is set for January 23, 2012, at 10:00 a.m. at the Paul G. Rogers Federal Building and United States Courthouse in West Palm Beach, Florida. Subsequently, an open court conference will commence at 11:30 a.m. on that same day.
DePuy ASR Litigation Updates Since Previous Status Conference
The last status conference in the DePuy ASR hip implant MDL was held on November 22, 2011 in Toledo, Ohio.** Since that time, a series of orders have been issued and the noticing, scheduling and taking of depositions have continued to move forward. Following the November 22, 2011 status conference, Judge Katz issued a series of orders to address potential discovery issues in an effort to keep the litigation progressing, avoid any delays and prevent unanticipated interruptions. Specifically, these orders clarified discovery procedures and provided guidelines to counsel on both sides to ensure the confidentiality of documents, the accuracy and completeness of Plaintiff Fact Sheets, and the sharing of costs and expenses between attorneys.***
DePuy Metal-On-Metal Hip Replacement Lawsuits Mount
According to a recent article in the New York Times, more than 5,000 metal-on-metal hip replacement lawsuits have been filed; 3,500 of these hip replacement lawsuits involve hip implants that were subject to the ASR hip recall.****In addition to monitoring developments in the DePuy ASR MDL, the lawyers at Bernstein Liebhard LLP are actively filing cases on behalf of individuals allegedly injured by artificial metal-on-metal hip implants in the following actions: In re: DePuy Orthopaedics, Inc.
