On March 25, 2011, preliminary discovery in In re: DePuy Orthopaedics, Inc., ASR Hip Implant Products Liability Litigation (“DePuy MDL”) began when plaintiffs issued three separate Notices of Oral and Video Depositions to defendants.  The DePuy MDL is currently pending before the Honorable David A. Katz in the U.S. District Court for the Northern District of Ohio.  During the 30(b)(6) depositions, which are slated to take place from April 26 through April 28, plaintiffs will attempt to elicit testimony from company executives on DePuy’s retention policies, electronically stored information, and corporate organization.  In the notices, plaintiffs identified specific topics they intend to address during the depositions, and requested particular documents related to the ASR hip systems that they would like defendants to produce at the depositions.  The purpose of this first round of depositions is to help plaintiffs gather information, which they will then use to target their substantive discovery requests as the litigation moves forward.
