We are excited to announce that the DePuy ASR cases we are handling have progressed to the next level.  Currently, our DePuy ASR injury attorneys are busy drafting and filing complaints on behalf of the Firm’s clients.  Once submitted to the court, each of the individual complaints will become part of the DePuy ASR MDL, which is currently underway in the U.S. District Court for the Northern District of Ohio before the Honorable David A. Katz.  Previously, Judge Katz issued several preliminary discovery orders, including an Amended Case Management Order (Order No. 4).  This order allows each plaintiff to utilize and complete a standardized short form complaint in order to file a lawsuit against DePuy.  Counsel for both plaintiffs and defendants agreed on the standard format of the short form complaint, which then received approval by Judge Katz. The standardized complaint promotes efficiency and expedites the litigation process. The short form complaint allows plaintiffs to make claims against DePuy for 23 different causes of action, including:  negligence, strict products liability, breach of warranty, fraudulent misrepresentation and violation of state consumer fraud statutes.  Additionally, the short form complaint permits plaintiffs to seek damages, including:  personal injury, wrongful death, economic loss, loss of services, and loss of consortium.  Similarly, defendants must file a master answer in response to each complaint.
