Bernstein Liebhard LLP, a nationwide law firm representing clients in transvaginal mesh lawsuits, reports that medical device manufacturer, Johnson & Johnson, announced on June 4, 2012 that it will cease sales of four of its Ethicon pelvic mesh implant systems. As reported by Bloomberg News, J&J has requested approval from the U.S. Food and Drug Administration (“FDA”) to stop “commercializing” the devices. The four Ethicon pelvic mesh implants subject to the J&J mesh recall include: (1) Gynecare TVT Secur System; (2) Gynecare Prosima Pelvic Floor Repair System; (3) Gynecare Prolift Pelvic Floor Repair System; and (4) Gynecare Prolift+M Pelvic Floor Repair System. Additionally, Ethicon, the Johnson & Johnson subsidiary that manufactures these pelvic mesh implants, has asked the FDA for 120 days to cease commercialization. This will give Ethicon time to notify patients affected by the J&J mesh recall, as well as provide hospitals and patients with sufficient time to select alternative treatments for their products. A company spokesman told Bloomberg News that these four Ethicon pelvic mesh implants will no longer be sold worldwide.

“The Ethicon withdrawal from market of several prolapse kits, as well as the TVT-Secur for treatment of SUI, confirms what plaintiffs have alleged from the start of this litigation–that any purported benefits of the mesh kits are not worth the significant safety risks to patients. These are poorly designed products that are very dangerous and should never have been placed on the market,” commented Bernstein Liebhard LLP partner Jeffrey S. Mr. Grand also serves on the Plaintiffs’ Steering Committee in the federal litigation, In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (“MDL No. 2327”), which is a consolidation of all the transvaginal mesh lawsuits filed in federal court against Johnson & Johnson, and its subsidiary, Ethicon, Inc. The federal transvaginal mesh lawsuits are currently pending in the U.S. District Court for the Southern District of West Virginia before Judge Joseph R. Goodwin.

Ethicon Pelvic Mesh Implant Systems Are Subject Of Mounting Litigation

Currently, Ethicon Inc. and Johnson & Johnson are defending hundreds of lawsuits in both state and federal courts filed by individuals alleging that the Ethicon pelvic mesh implant systems caused them to develop serious injuries. According to Bloomberg News, the J&J mesh recall was initiated because nearly a thousand women have filed lawsuits claiming that the Ethicon pelvic mesh implants caused their injuries. Specifically, the women allege that the Ethicon meshes have eroded and shrank over time, causing pain and injuries, after the devices were threaded into place through vaginal incisions.
