Bernstein Liebhard LLP reports that on January 12, 2012, a series of additional depositions of DePuy Orthopeadic executives were noticed in In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation (“MDL No. 2197”), which is currently underway in the U.S. District Court for the Northern District of Ohio.*  Among the depositions noticed are those of the Senior Engineering Fellow, the Director of Strategic Outcomes, the Vice-President of Worldwide Regulatory Affairs, and the Vice-President of Worldwide Clinical Affairs.  These depositions are scheduled to take place in February and March 2012.

Depositions Could Yield Information Surrounding ASR Hip Recall

Interestingly, in February 2010, Sally Hunter, the Vice-President of Worldwide Regulatory Affairs and one of the noticed deponents, reported that DePuy was phasing out sales of the ASR hip implants for commercial reasons, not because of safety issues.  As reported by the New York Times, she stated, “With declining sales of this particular product in its market segment, we are focusing on newer technologies.”  A month later, DePuy first acknowledged that its ASR hip implant systems had excessively high failure rates and sent letters to doctors warning them of this important information.  In August 2010, DePuy issued a voluntary worldwide recall of its ASR hip implant systems, after receiving data from the National Joint Registry of England and Wales that 1 out of every 8 patients (12%-13%) who received the ASR hip implants had to undergo revision surgery within five years of implant.  At the time, DePuy sent letters to surgeons worldwide asking them to notify their patients of the recall.  Since the recall, litigation over the defective ASR hip implants has surged.

According to a recent article in the New York Times, more than 5,000 metal-on-metal hip replacement lawsuits have been filed; 3,500 of these hip replacement lawsuits involve hip implants that were subject to the ASR hip recall.  In addition to monitoring developments in the DePuy ASR hip recall litigation, the lawyers at Bernstein Liebhard LLP are actively filing cases on behalf of individuals allegedly injured by the artificial ASR metal-on-metal hip implants in In re: DePuy Orthopaedics, Inc.
