Child Safety Seat Lawsuits

When a child safety seat manufacturer fails to meet safety standards set by the government and a child is injured, a lawsuit may help the child’s parents or caregivers seek compensation for their child’s injuries. For example, with a child safety seat injury lawsuit, injured families may be able to collect compensation for medical bills, the cost of future medical care, pain and suffering, and more. In addition, a child safety seat injury lawsuit may help prevent future injuries by raising awareness about a child safety seat defect and motivating the manufacturer to remove the defective product from the market.

In one lawsuit, a child safety seat manufacturer agreed to pay $4.25 million to settle a lawsuit brought by the family of a child who was paralyzed in a 1989 car crash. The defendant in the lawsuit was Kolcraft Enterprises Inc., the maker of the booster seat in which the child was sitting when a car driven by his mother skidded on ice and crashed head-on into another vehicle. The child at the center of the lawsuit, now 5, came partly out of his child safety seat, injuring his spinal cord and leaving him paralyzed from the waist down. The defective child safety seat manufacturer’s lawyer called the lawsuit “a highly disputed claim. But sometimes you have to settle because a jury verdict can be very high.

Common Car Seat Defects Giving Rise to Lawsuits
Between 1998 and 2001, five child safety seat recalls were issued involving nearly 10 million child safety seats. In addition, many other safety seats for infants, babies, and children are believed to have safety issues. Some of the most common child safety seat defects giving rise to lawsuits include:

  • weak shells
  • defective handles
  • flammable materials
  • base/shell separation and weak construction
  • sudden releases due to defective harnessing systems
  • unanticipated rotation

Do I Qualify for a Child Safety Seat Injury Lawsuit?
The manufacturers of child safety seats are required to maintain specific safety standards set by the government. When a manufacturer fails to meet federal standards, and use of a child safety seat results in serious or fatal injuries to a child, a lawsuit may be a viable option.
