During a cryptic lunch meeting Craig Swenson had with the president of Johnson & Johnson’s DePuy unit in March 2010, the California surgeon was not yet aware that the DePuy ASR hip recall would be issued over the summer, The Washington Post reported.

What Swenson was aware of, according to the testimony he filed Feb. 8 in a DePuy ASR hip lawsuit hearing in Los Angeles state court, was that 38 percent of the 200 artificial hips used in patients had failed, which was much higher than with any other type of hip replacement. 

According to the Feb. 8 article, Swenson testified in the first of 10,000 DePuy ASR hip lawsuits to be heard in court that the president of DePuy had met with him, along with seven other San Diego surgeons who heavily used the metal-on-metal hip replacement, during the spring of 2010.

Swenson said: “He informed me that they were going to discontinue sales of the ASR,” Swenson said. “He didn’t give me a reason why.”

DePuy ASR Hip Recall Follows Early Hip Failure Rates

A few months later, Swenson found out. 93,000 metal hip implants were recalled in August 2010 because of early hip failure rates. At the time, Johnson & Johnson said 12 percent of the DePuy ASR hip replacement devices failed in the United Kingdom within the first five years. Last year though, that rate of failure was found to be much higher than that—at over 40 percent—based on a report from an Australian registry.

After Swenson received the warning, he said he “pretty much stopped” using the ASR since more of his patients were reporting pain and high metal levels. 

According to court documents, approximately 10,000 DePuy ASR hip lawsuits claiming injuries stemming from this complication along with many others are pending in courts around the U.S. Most of these have been filed in a federal multidistrict litigation (MDL) in the U.S. District Court for the Northern District of Ohio.
