Bernstein Liebhard LLP has begun to file Stryker hip lawsuits in a consolidated litigation recently created in New Jersey Superior Court as well as a Biomet hip replacement lawsuit in Indiana federal court, the Firm reports.

It was also announced in the past two weeks that our lawyers have been actively involved in the federal litigation of DePuy Pinnacle hip lawsuits underway in Texas federal court, and keeping track of developments in the second DePuy ASR hip lawsuit trial in the Circuit Court of Cook County, Illinois, set to begin Mon., March 11, 2013.

DePuy Pinnacle Hip Lawsuits, Biomet Hip Replacement Lawsuits Pending in U.S. Federal Courts

According to Bernstein Liebhard LLP, the Stryker hip lawsuits were filed in Bergen County Superior Court Feb. 25, 2013 on behalf of patients who received the Rejuvenate device and name Howmedica Osteonics d/b/a Stryker Orthopaedics as Defendant. (In re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296)

Claims pending in this litigation have been filed on behalf of patients allegedly injured after the Stryker hip recall, which was issued in July 2012 after post-market surveillance indicated the potential for the metal components of the device to rub together, causing fretting and corrosion. In turn, this may lead to a host of adverse tissue reactions and other complications including metallosis (metal ion poisoning).

Meanwhile, in the U.S. District Court for the Northern District of Indiana, Bernstein Liebhard LLP filed a complaint March 1, 2013 on behalf of a patient who received the Biomet M2a Magnum hip implant. Court documents indicate there to be at least 141 claims pending in the litigation of federally-filed Biomet hip lawsuits.

Last month, the Court granted permission for claims to be filed directly in the Northern District of Indiana via a Case Management Order. (In re: Biomet M2a Magnum Hip Implant Products Liability Litigation – MDL No. 2391)

The Firm also reported this week that the number of DePuy Pinnacle hip lawsuits pending in the MDL underway in the U.S. District Court, Northern District of Texas now exceeds 3,800. There are now 3,882 claims filed by plaintiffs who claim to have been injured by the DePuy Orthopaedics-manufactured metal-on-metal hip replacement utilizing the Ultamet liner, according to a Master Case List filed with the Court on March 1, 2013.
