On March 24, 2011, actor Martin Sheen took the stand in a New Jersey courtroom to testify about the dangerous side effects of Accutane use.  Fellow actor, James Marshall is suing Roche, the manufacturer of the popular acne drug.  Marshall is claiming that Accutane caused his inflammatory bowel disease, causing him to undergo emergency surgery to have his colon removed.  Marshall is seeking $11 million in damages from Roche.  Marshall claims that his Accutane use and resulting injuries put an end to his promising movie career.

Growing Litigation Could Lead to Future Accutane Settlements

Currently, over 3,000 Accutane lawsuits have been filed in New Jersey state court alleging that Roche failed to warn consumers that Accutane can lead to inflammatory bowel disease.  All of the Accutane cases filed in New Jersey state courts have been consolidated into a state mass tort program (“MTP”).  Similar to a federal MDL, this tool transfers, consolidates and coordinates cases before one state court judge.  Although a few cases have been tried, it is possible that Accutane settlements of the individual lawsuits will be reached prior to trial.  As the number of lawsuits filed against Roche continue to mount and media coverage increases, hopefully this will incentivize Roche to actively pursue Accutane settlements with injured parties.  Although a growing number of lawsuits are being filed by Accutane users, Roche is either refusing to engage in Accutane settlements or Accutane settlements are not being publicly disclosed.  To date, eight Accutane cases have gone to trial, and Roche has been ordered to pay at least $45 million in damages.  Roche must decide whether to continue defending these lawsuits or attempt to reach Accutane settlements in order to mitigate jury damages.
