Accutane, also known as isotretinoin, is a derivative of Vitamin A and is one of the most popular oral medications used to treat acne.  Unfortunately, Accutane has been linked to several serious side effects including inflammatory bowel disease, birth defects, and heightened depression.  These serious side effects have led many individuals injured by Accutane to file lawsuits.  Notably, these lawsuits are individual lawsuits.  There is no  Accutane class action lawsuit pending. Below we explain the difference between an Accutane class action lawsuit and an individual Accutane personal injury action.

Accutane Class Action Lawsuit or Individual Accutane Lawsuit? 

A class action lawsuit is a type of lawsuit where one individual brings a lawsuit and represents the claims of all other individuals who are similarly situated. The individual bringing the lawsuit generally serves as the class representative.  Our firm has extensive experience handling class action lawsuits, but typically the dangerous drug, medical device, and whistleblower cases we handle are individual actions and not class actions. In some instances, however, a class action lawsuit is appropriate. For instance, although there is no Accutane class action lawsuit, in 2006, a Paxil class action lawsuit was filed on behalf of injured victims against GlaxoSmithKline. The attorneys representing the class alleged that the company promoted the drug for use in children without warning of the increased suicide risk and withdrawal side effects. The lawsuit was settled for $63.8 million and the class members (those who bought Paxil for their children) received compensation for their Paxil purchases.

In contrast, an individual lawsuit, the type of action normally filed in the case of a defective drug or medical device, involves a claim by an individual for his or her own unique injuries. Liability is proven on an individual basis. In an individual lawsuit, our firm files a lawsuit for our client based on the client’s own unique circumstances, and liability and damages are determined accordingly. For example, with an individual Accutane lawsuit, as opposed to an Accutane class action lawsuit, our firm would represent one person for their own unique injuries sustained from their Accutane use.
