On February 28, 2011, a DePuy class action lawsuit was filed in Australia alleging that the Johnson & Johnson subsidiary negligently manufactured its hip replacement implants.  This DePuy class action was filed on behalf of 5,000 individuals who received the ASR metal-on-metal implants between 2003 and 2009.  Tammy Stanford, 40, of Hobart, Tasmania is serving as the lead plaintiff in this DePuy class action lawsuit.  Stanford received an ASR hip replacement in 2005.  Similar to others who received the DePuy hip replacement, she had to undergo painful revision surgery in order to remove the defective implant.

Lawsuits Against DePuy Continue to Mount

Although a few DePuy class action lawsuits have been filed, most of the litigation surrounding the defective hip implants are individual personal injury lawsuits.  A class action lawsuit is a type of lawsuit where one individual brings a lawsuit and represents the claims of all other individuals who are similarly situated.  The individual bringing the lawsuit generally serves as the class representative.  In the Australian DePuy class action lawsuit, the class representative is Tammy Stanford.

Although our firm has extensive experience handling class action lawsuits, typically dangerous drug, medical device, and whistleblower cases are brought as individual actions and not class actions.  In contrast, securities cases and consumer fraud cases are more often brought as class actions.  Currently, our firm is filing individual lawsuits on behalf of clients who were injured by the defective DePuy hip implants.  Unlike the DePuy class action lawsuit filed in Australia, our firm is filing individual lawsuits against the manufacturer based on each client’s own unique circumstances.  For example, in an individual DePuy lawsuit, as opposed to a DePuy class action lawsuit, our firm would represent one person for the specific injuries sustained stemming from the defective DePuy implant, and liability and damages will be determined accordingly.
