On August 24, 2010, DePuy Orthopaedics and its parent company, Johnson & Johnson, issued a worldwide recall of the DePuy ASR hip replacement (a metal-on-metal artificial hip system), noting that the artificial hip system may be prone to fail within a few years after implantation. Status Of The DePuy Litigations
Currently, DePuy is defending thousands of lawsuits stemming from both the recalled ASR devices and the Pinnacle hip systems. Both devices are metal-on-metal implants, and the injuries alleged by plaintiffs are similar. However, the Pinnacle hip system has not been recalled. Thus, a DePuy hip replacement settlement offer will more likely be made to plaintiffs in the ASR litigation first. Litigating these cases would be extremely costly and given that the company has already admitted that there is a fault with these products, it may be more willing to enter into a hip replacement settlement in regards to their ASR implants.
DePuy has made clear that it will vigorously defend the Pinnacle lawsuits and has no intention of offering anyone a hip replacement settlement. However, individuals who received a Pinnacle hip system should not be deterred from filing a Pinnacle lawsuit. Although the Pinnacle plaintiffs face an added hurdle because the hip system has not been recalled, recent research suggests that the Pinnacle systems have the same design defects as the ASR products. In fact, there is speculation that the Pinnacle hip systems could be the subject of a recall.
Both groups of DePuy hip replacement lawsuits filed in federal courts throughout the country have been centralized and consolidated into two separate multidistrict litigations. A multidistrict litigation consolidates all of the individual lawsuits in one court for pretrial proceedings. If a hip replacement settlement is not reached by the end of pretrial proceedings, the individual lawsuits will be remanded back to the courts in which they were originally brought for trial.
DePuy Hip Replacement Class Actions
In addition to the individual lawsuits, DePuy ASR hip replacement class actions have been filed in California and Ohio on behalf of individuals throughout the United States who received one of the defective DePuy ASR hip replacements. One of these hip replacement class actions seeks a DePuy hip replacement settlement that would require the manufacturer to pay for the necessary testing and medical monitoring that will be required for individual who have the DePuy ASR hip replacement, but have not yet experienced any problems.
